Definitions
"User" means users who have started to use any WebXL Services.
"We / us" means WebXL.
Introduction
By registering on WebXL and/or purchasing one of our website service packages you are agreeing to comply with and be bound by the following terms of service, which will govern WebXL's relationship with you in relation to this website. If you disagree with any part of these terms of use or privacy policy, please do not use our website.
Web site Service
WebXL hosts a system that allows you to build a website from your content and photos without having to learn any complicated HTML, database management skills or web scripting languages. Any fees you pay are for this service only, you are not buying or trialling a website that you can retain or copy for use outwith our server or services.
Terms of Service modification
From time to time WebXL may change these Terms of Service. If there are any major changes all WebXL users will be notified.
Code of conduct
i) You must take all reasonable care not to upload any data that may contain a virus or other harmful code. ('Data' includes, but is not limited to: any textual content or photos.)
ii) You must not use any WebXL service to display or store any data that is abusive, obscene, sexually explicit, pornographic or unlawful.
iii) You must only store or display data that you own the copyright to or have had express permission to display from the copyright owner.
iv) No data must be displayed or stored, that contains any person under 18 years of age in a sexual or provocative way.
v) You must not link to, discuss, or display any information regarding illegal or fraudulent activities.
vi) You are responsible for ensuring your account details remain confidential and that your WebXL account cannot be accessed by anyone else who may use yours or any computer.
Changes to service
From time to time WebXL may enhance or remove existing features or add new features. As all WebXL websites are based around the same core system your website will be affected by such changes.
Domain Names
For certain WebXL service packages we will register a domain name for your website on your behalf. Although the domain name will belong to you, all code used to present your website remains our intellectual property and at the end of your service period will be removed from this domain name. The cost of renewing the domain during your WebXL service period will be paid by WebXL. Should you want the domain to be transferred to you at the end of the service period, a renewal fee of £25 may be levied if we have recently renewed your domain name for you.
Although we will make our best efforts to ensure your domain is renewed before it's expiry, we can make no guarantee of this and accept no liability for failure to renew your domain name. We also rely on you providing and maintaining up-to-date contact information and failure to do so may affect the renewal of your domain name.
Payment methods
The payment methods we accept are direct bank transfer / cheque (UK only) and Paypal.
Cancellation
You can cancel your paid account at any time, but must give 30 days notice.
Refunds
Refunds will be provided at our discretion.
Intellectual Property rights
WebXL retains ownership of all graphics, design, code and associated appearance of your website. Unless stated otherwise, you will retain copyright ownership and related rights for all information and photographs you add to your WebXL website. You agree to us keeping backup copies of all data you submit to WebXL, for the sole purpose of ensuring a high level of service to you.
Limitations
Loss of data
Although we take every care with the data you submit to us, we are not responsible for any loss or damage to it. You are supplying the material at your own risk and we strongly recommend you keep your own backups.
Bandwidth limits
We run a fare use policy on bandwidth: if you consistantly use more than a fair use limit of around 100 gig of bandwidth we may include additional charges of £0.60 per gigabyte exceeding the allocated monthly limit, or suspend the service to you. The use of your account is your responsibility and you should take due care not to exceed the stated limits.
Warranty
WebXL makes no warranty that this service will meet your requirements, or that the service will be error-free, secure or un-interrupted.
You warrant to us that you are 18 years of age or older and that you will use this service in accordance with this Terms of Service document.
Liability
WebXL shall not be liable for any direct, indirect, special or consequential damages arising out of your use or inability to use the WebXL services. In no event can WebXLs total liability to you for any losses or damages exceed the amount you paid for your WebXL service package.
Indemnification
You agree to indemnify WebXL, its employees and all related third-parties harmless against any and all liabilities, damages, claims and expenses that may occur from your use or misuse of this service.
General
These Terms of Service shall be governed by and interpreted in accordance with the laws of England and Wales and Scotland and Ireland.
We reserve the right to change these Terms Of Service without notice.
